Unit information
Commercial law looks closely at the statutory and common law regimes relating to consumer transactions and consumer protection.
Throughout this unit, you will examine the Sale of Goods Act 1923 (NSW) and its implication for business and private consumers as well as traders.
You will also examine the Australian Consumer Law regime under the Competition and Consumer Act 2010 (Cth) from a consumer's perspective. This includes the law relating to misleading and deceptive conduct, consumer guarantees and manufacturer's liability. Additionally, you will examine the law applying to electronic commerce, credit, insurance, bankruptcy, agency and guarantees.

Learning outcomes
Upon completion of this unit, students will be able to:
- demonstrate specialist knowledge of the nature and scope of the principles of commercial law and the relevant legislative provisions and case law;
- use autonomy to demonstrate a well-developed ability to critically reflect, investigate and evaluate policy issues relating to commercial law, and the regulation of commercial law transactions and their effectiveness e.g., sale of goods, consumer protection, consumer credit, agency, bailment, insurance, guarantee and ecommerce;
- exercise cognitive skills to identify legal issues relating to commercial law disputes and issues, employ the skills of legal research, reasoning and argument to apply commercial law principles to determine the obligations of those involved in the dispute; and
- use well-developed and autonomous judgment to produce clear and coherent written communications that are based upon analysis, legal research, synthesis and application of professional judgement to consider questions related to commercial law issues and outcomes to advise interested parties.
